Terms and Conditions of the beztroskaonline store and Privacy Policy.
General provisions
The Regulations define the rules for the use of the Store by Users operated by the Seller, in particular for placing orders for products available in the Store, delivering ordered products to the Customer, paying the sales price of the products by Customers, the Customers' right to withdraw from the contract and the rules for submitting and considering complaints.
The Regulations are continuously available on the Store's website in a manner enabling Users to obtain, reproduce and record them.

Customer – User who concludes a Sales Agreement within the Store.
Consumer – a consumer within the meaning of the provisions of the Act of 23 April 1964 – the Civil Code (consolidated text: Journal of Laws of 2014, item 121) is a natural person who performs a legal act not directly related to his or her business or professional activity.
Entrepreneur – an entrepreneur within the meaning of the provisions of the Act of 23 April 1964 – Civil Code (consolidated text: Journal of Laws of 2014, item 121), i.e. a natural person, a legal person and an organizational unit conducting business or professional activity on its own behalf.
Sales Agreement – sales agreement concluded in the Store under the terms and conditions set out in the Regulations between the Seller and the Customer.
Regulations – these Store Regulations referred to in Article 8 of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended).
User – an Internet user who uses the Store.
III. General terms and conditions of use of the store
The use of the Store is possible provided that the User's IT system meets the following minimum technical requirements:
a) use of Internet Explorer 8.0, Mozilla Firefox 12.0, Safari 8.0 browsers.
b) software enabling viewing of documents and photos.
c) having a current, active and properly configured e-mail account.
When using the website, cookies are installed on the Service User's IT system. Cookies must be enabled to use the website.
The User is obliged to refrain from any activity that could affect the proper functioning of the Store, including in particular any interference with the content of the Store or its technical elements.
The User is obliged not to disclose to third parties his/her login and password used to log in to the Store.
The Seller, to the fullest extent permitted by law, shall not be liable for any disruptions, including interruptions, in the operation of the Store caused by force majeure, unauthorized actions of third parties or incompatibility of the Store with the User's technical infrastructure.
A user who is not a natural person may use the Store through persons authorized to act on his or her behalf.
The User is prohibited from using the Seller's name, the Store's logo, the Store's graphic elements, and the Store's layout and composition, except as expressly provided in the Terms and Conditions or when the use of the indicated copyright and industrial property is possible based on the express written consent of the Seller or authorized third parties. The User is prohibited from taking any action aimed at reproducing the Store, in particular on websites and domains associated with the User.

Register in the store
Registration in the Store, as well as the use of its functionalities, are free of charge.
Registration in the Store requires the following conditions to be met:
a) correctly complete the form available on the Store's website, providing personal data, e-mail address and password.
Browsing the Store's assortment and placing orders does not require registration.
In the case of a legal person and an organizational unit without legal personality, registration in the Store and all other activities of this entity in the Store may only be performed by a person who is authorized to perform on behalf of this entity all activities related to the use of the Store (including registration) and to exercise all rights and obligations of this entity as a User (including the Customer).
In the event of any change in the User's data provided during registration, the User should update them before concluding another Agreement, using the appropriate form available in the Store.
Upon registration in the Store, a User Account is created, which serves as a collection of resources that collects information about the User and their activities within the Store in connection with concluded Agreements. Within their account, the User has access to, among other things, their order history in the Store and the ability to save projects. Each time they log in to their User Account, they use the data provided in the registration form.
Placing orders
General provisions
Information regarding goods available in the Store does not constitute an offer within the meaning of Article 71 of the Civil Code, but an invitation to submit offers (orders) by Users.
All prices are given in Polish zloty or another currency selected by the User in the Store menu and include VAT and do not include shipping costs.
Shipping costs depend on the size of the order and the country of delivery. The total cost of the order (i.e., the price of the products plus shipping costs) is indicated before the User places the order.
By placing an order, the User makes an offer to purchase a specific product.
Users can place orders in the Store 7 days a week, 24 hours a day. Subject to the remaining provisions of the Terms and Conditions, in particular those regarding maintenance breaks, orders placed on non-working days will be processed on the first business day following the day on which the order was placed.
All goods sold include a detailed description of their properties. It is also possible to individually agree on the properties of the goods between the Buyer and the Seller, provided that such changes are possible due to the characteristics of the given goods.
Placing orders for personalized products
In addition to ready-made universal products such as universal inserts, sleeping bags available in the current collection, stroller bags, ready-made pillows, the Beztroska I sew custom-made products . All products that are not finished are non-returnable . Please note: adding additional holes, such as for folding a stroller into the insert or sleeping bag, also personalizes the product. Therefore, if you are considering a return, please do not make any changes.
Legal basis: Consumer Rights Act (Journal of Laws of 2014, item 827, art. 38), which states:
- Specific properties of the items that are the subject of the contract, which – in the event of the consumer withdrawing from the contract – would prevent or significantly hinder the entrepreneur from reselling these items to another buyer, e.g. a contract in which the subject of the provision is a non-prefabricated item, manufactured according to the consumer's specifications or intended to meet his individual needs, are not subject to return.
Users have the option of using the Store, including concluding Sales Agreements, both after registering in the Store and without registration.
In the case of registration, the User should log in to his/her User account in order to place an order.
The Customer concluding a Sales Agreement without registration is obliged to complete all fields of the form correctly and provide the data necessary to establish, determine the content, change and properly execute the Sales Agreement concluded by the Customer in accordance with the actual state.
The goods presented by the Seller—hand-sewn children's products—are not finished products. The user orders a specific product from the Seller or designs their own by selecting fabric patterns and colors. Using the order form, the user orders a product tailored to the created design. The order is processed after confirmation and receipt of payment to our company account.
To place an order, the User places the product they intend to purchase (an insert, sleeping bag, bedding, custom-made hat, etc.) in the Virtual Cart. The User can freely manage the contents of the Virtual Cart by adding additional items or removing them from the Virtual Cart.
After finalizing the items for purchase, the User is directed to an online form for placing orders in the Store. The order form may consist of sub-forms for specifying:
– invoice details for the goods,
– delivery address,
– baby's name (each product delivered to you will have a personalized name on the paper tag. We do not embroider or embroider names on products).

Placing an order constitutes an offer within the meaning of the Civil Code, submitted by the User to the Seller.
Confirmation of receipt of the order will be automatically sent to the User's email address. Confirmation of receipt of the order does not constitute acceptance of the order for processing.
If the order can be fulfilled, a confirmation message will be sent to the User's email address confirming that the order has been accepted for fulfillment (acceptance of the offer). If the Seller determines that the order was placed incorrectly, the Seller will inform the User.
The contract is concluded when the Seller sends the User information about the acceptance of the order for execution.
If the Customer's order cannot be fulfilled, the Seller will immediately inform the Customer about the situation by sending a message to the e-mail address provided by the Customer or by telephone to the number provided by the Customer.
If the Seller is unable to perform the service with the properties individually requested by the Customer due to a temporary impossibility of fulfilling it, the Seller may, with the Customer's consent, provide a substitute service of the same quality and purpose and for the same price or remuneration or in another manner agreed by the parties.
The Agreement is concluded in Polish or in another language chosen by the User.
Payment of the price
Payment for the purchased goods can be made before receipt of the ordered goods (payment in advance):

(In the case of payment by bank transfer, the transfer order must include the Customer's name and surname and the Order number). The order will be fulfilled after the Seller receives confirmation of the payment being credited to his bank account.

The User purchases the goods in accordance with the price and delivery costs applicable at the time of placing the order.
for every order. By placing an order, the user accepts the issuance of a receipt, which will be delivered with the order. Upon request, the company can issue a VAT invoice (please specify this in the order notes and provide the invoice details).
Failure to receive payment to the bank account or via one of the electronic payment systems accepted by the Seller at a given time within 14 days from the date of order confirmation, in the case of choosing payment in advance as a form of payment, will result in the order being canceled.
All goods sold on the Store's website are new and made to order. The Seller is obligated to deliver goods free from defects. The Seller is liable for defects in goods under the terms specified in applicable law. This liability is regulated by the provisions of the Civil Code, in particular Article 556 and Articles 5561-5563 of the Civil Code.
Delivery
The store sells goods in Poland and to other EU countries. International shipping costs, handled by DPD and Poczta Polska: parcels up to 1 kg – PLN 49. Prices for larger parcels are determined individually using the calculator on the website. For XL shipments, such as two sleeping bags or a sleeping bag and a tote bag, please contact [email protected] to determine shipping costs.
Goods purchased through the Store are delivered to the address indicated by the Customer.
Within Poland, goods purchased via the Store are delivered by DPD, InPost (Parcel Lockers and courier services) and Orlen Paczka.
Shipping costs depend on the size of the order and the delivery address. They are displayed each time the User selects a delivery method, both before and after placing the order. The cheapest shipping cost within Poland is PLN 12 gross (Orlen Paczka).
Orders over PLN 500 are eligible for free delivery to Orlen Paczki locations or via DPD courier within Poland. The Seller provides information on the Store's website about the specific product's delivery date. Order processing time is up to 14 business days during peak season, from the moment of payment to the company account.
In the event of a longer delivery time, the customer will be informed about this on the product card or by email.
The Seller is not responsible for non-delivery of goods due to reasons attributable to the Customer, e.g. due to providing an incorrect delivery address.
Withdrawal from the contract
In the event of the purchase of goods made to order, as well as products that cannot be returned after opening for health protection reasons (hygienic masks), the Consumer, in accordance with Article 38 paragraphs 1 and 3 of the Act of 30 May 2014 on consumer rights, is not entitled to withdraw from the contract.
In the event of purchasing goods that are not made to individual order, the consumer has the right to withdraw from the distance contract in accordance with the following principles:
The customer has the right to withdraw from this contract within 14 days without giving any reason.
The deadline for withdrawal from the contract expires after 14 days from the day on which the Customer came into possession of the goods or on which a third party other than the carrier and indicated by you came into possession of the goods.

In order to meet the deadline for withdrawal from the contract, it is sufficient for the Customer to send information by e-mail regarding the exercise of the Customer's right to withdraw from the contract before the deadline for withdrawal expires.
If you withdraw from this contract, we will reimburse you all payments received from you, including the costs of delivery (excluding the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), immediately and in any event no later than 14 days from the day on which we are informed of your decision to exercise your right to withdraw from this contract. We will make the reimbursement using the same payment method that you used for the initial transaction.
If the Store has not offered to collect the item from the Customer, it may withhold reimbursement of payments received from the Customer until it receives the item back. The Customer should return the item to the following address:

, immediately, no later than 14 days from the date on which the Customer notified the Customer of their withdrawal from this contract. The deadline is met if the Customer sends the item back before the expiry of the 14-day period.
The customer is obliged to bear the direct costs of returning the goods.
The Customer is liable for any reduction in the value of the item resulting from its use in a manner other than necessary to establish the nature, characteristics and functioning of the item.
Goods returned by the Customer should be packaged appropriately to ensure no damage to the shipment during transport.
The right to withdraw from a contract concluded away from business premises or at a distance does not apply to the consumer in relation to contracts:
1) provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the commencement of the service that after the entrepreneur has performed the service, he will lose the right to withdraw from the contract;
2) in which the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the deadline for withdrawal from the contract expires;
3) where the subject of the provision is a non-prefabricated item, manufactured according to the consumer’s specifications or intended to meet his individual needs;
4) where the subject of the performance is an item that spoils quickly or has a short shelf life;
5) where the subject of the service is an item delivered in a sealed package which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery;
6) where the subject of the performance are items which, due to their nature, are inseparably connected with other items after delivery;
7) where the subject of the service are alcoholic beverages, the price of which was agreed upon at the conclusion of the sales contract, the delivery of which can only take place after 30 days and the value of which depends on market fluctuations over which the entrepreneur has no control;
8) in which the consumer has expressly requested the trader to come to him for urgent repair or maintenance; if the trader provides additional services other than those requested by the consumer, or supplies items other than spare parts necessary for repair or maintenance, the consumer has the right to withdraw from the contract in respect of additional services or items;
9) where the subject of the provision are sound or visual recordings or computer programs delivered in a sealed package, if the package was opened after delivery;
10) for the supply of newspapers, periodicals or magazines, with the exception of subscription agreements;
11) concluded through public auction;
12) for the provision of accommodation services other than for residential purposes, transport of goods, car rental, catering, services related to leisure, entertainment, sports or cultural events, if the contract specifies the day or period of service provision;
13) for the supply of digital content that is not recorded on a tangible medium, if the performance of the service has begun with the express consent of the consumer before the expiry of the withdrawal period and after the entrepreneur has informed the consumer about the loss of the right to withdraw from the contract.
Warranty and complaint provisions
The Seller guarantees the Delivery of Goods free from physical and legal defects. The Seller is liable to the Customer if the Goods have a physical or legal defect (warranty).
If the Product has a defect, the Customer may:
a) submit a declaration of price reduction or withdrawal from the Sales Agreement, unless the Seller immediately and without undue inconvenience to the Customer replaces the defective Goods with defect-free ones or removes the defect.
This limitation does not apply if the Goods have already been replaced or repaired by the Seller, or if the Seller has failed to fulfill the obligation to replace the Goods with defect-free ones or remove the defects. The Customer may, instead of the Seller's proposed removal of the defect, request replacement of the Goods with defect-free ones or, instead of replacement of the Goods, request removal of the defect, unless bringing the Goods into conformity with the contract in the manner chosen by the Customer is impossible or would require excessive costs compared to the method proposed by the Seller. When assessing the excessive costs, the value of the defect-free Goods, the type and significance of the identified defect, and the inconvenience to which the Customer would be exposed under another method of satisfaction are also taken into account.
b) demand replacement of the defective Goods with defect-free ones or removal of the defect. The Seller is obligated to replace the defective Goods with defect-free ones or remove the defect within a reasonable time without excessive inconvenience to the Customer.
The Seller may refuse to satisfy the Customer's request if bringing the defective Goods into compliance with the Sales Agreement in the manner chosen by the Customer is impossible or would require excessive costs compared to the other possible method of bringing the defective Goods into compliance with the Sales Agreement. The costs of repair or replacement are borne by the Seller.
A Customer who exercises warranty rights is obligated to deliver the defective item to the Seller's address. In the case of a Customer who is a Consumer, the Seller covers the delivery costs.
Complaints
Upon receipt of the shipment, the Customer is advised to check for any damage to the outer packaging during transport. Any damage to the shipment, including a broken seal (tape), constitutes grounds for refusing to accept it from the courier. In such a situation, the Customer is advised to contact the Seller immediately.
After acknowledging receipt of the parcel, it is possible to open the parcel in the presence of the courier - if any discrepancies are found, a discrepancy report is prepared.

To expedite the complaint process, it is recommended that when filing a complaint about a purchased product, the customer provide proof of purchase or a copy thereof and provide information and circumstances regarding the subject of the complaint, in particular the type and date of the defect, the requested method of bringing the product into compliance with the contract, and the customer's contact information. If the customer does not have a receipt, please provide the order number on the complaint form. IMPORTANT: Please ensure that the product submitted for complaint is clean. The warranty for Beztroska is 24 months from the date of delivery to the customer.
A Customer exercising warranty rights is obligated to return the defective goods to the Seller.
The Seller will respond to the Customer's complaint within 14 calendar days and notify the Customer of its acceptance or rejection, as well as the next steps.
If the Customer's complaint is resolved in favor of the Customer, the Seller will immediately replace the defective product with a defect-free one or immediately remove the defect and return it at its own expense. The Seller will also refund the Customer the cost of returning the product within 7 days to their bank account. If the product cannot be replaced, the defect cannot be removed, or the price cannot be reduced, the Seller will refund the amount immediately, no later than 7 days.
Complaints regarding the provision of services electronically.
The Seller takes steps to ensure the proper operation of the Store, to the extent that results from current technical knowledge, and undertakes to remove any irregularities reported by Customers within a reasonable time.
Customers may report any irregularities related to the operation of the Store by email to: [email protected] . In their complaint, the Customer should provide their name, mailing address, and the type and date of the irregularity related to the operation of the Store.
Extrajudicial methods of pursuing claims
Detailed information on the possibility for a Customer who is a consumer to use extrajudicial methods of dealing with complaints and pursuing claims as well as the rules of access to these procedures are available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Trade Inspection and at the following websites of the Office of Competition and Consumer Protection:

A Customer who is a consumer has, among others, the following options for using out-of-court complaint and redress mechanisms:
• The Customer is entitled to apply to the permanent consumer arbitration court operating at the Trade Inspection with a request to resolve a dispute arising from the concluded Sales Agreement.
• The Customer is entitled to apply to the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings to amicably resolve the dispute between the Customer and the Seller.
The Customer may obtain free assistance in resolving a dispute between the Customer and the Seller, also using the free assistance of a district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (including the Consumer Federation, the Association of Polish Consumers). Advice is provided by the Consumer Federation on the toll-free consumer hotline number 800 007 707 and by the Association of Polish Consumers at the email address: [email protected] .
Personal data protection
Beztroska Ilona Dziedzic declares that it protects Users' personal data in accordance with the principles and in accordance with applicable data protection regulations, in particular Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation/GDPR). Beztroska Ilona Dziedzic, hereinafter referred to as the Seller, declares that it applies technical and organizational measures ensuring the protection of processed data appropriate to the threats and categories of data being protected, and in particular protects Users' personal data against unauthorized access, loss, or damage.
During the product ordering process, the Buyer voluntarily provides their personal data to the extent required by the Seller.
The personal data obtained by the Seller will be processed by the Seller for the following purposes:
a. providing the sewing services referred to in these Terms and Conditions;
b. settling payments for ordered products;
c. pursuing claims for payments for placed orders;
d. and, if the User has consented, for the purpose of sending information about the User's products/services electronically.
The User's personal data is processed:
a. for the period necessary to complete the sale, as well as to settle payments and pursue claims;
b. in the case of processing based on consent, personal data are processed until the consent is withdrawn, provided that the withdrawal of consent does not affect the lawfulness of the processing based on consent before its withdrawal.
At any time, the Buyer may oblige the Seller, by sending an appropriate inquiry, including by email, to provide information on the status of their personal data being processed.
The Buyer also has the right to request the deletion, addition, or modification of the personal data processed by the Seller.
Detailed information for Users regarding the processing of personal data, including the purposes and basis of processing, specifying the applicable legal provisions, processing periods, and their rights, is provided to Users each time their personal data is collected. Additionally, detailed information regarding the processing of personal data by the Service Provider is included in the Privacy Policy.
Privacy Policy
WHAT PERSONAL INFORMATION IS COLLECTED AND USED BYbeztroska
Users of our store are not required to provide any personal data until they decide to register with the Store. Shopping at beztroskadoes not require creating an account or registering.
The controller of personal data is Beztroska Ilona Dziedzic, entered into the Central Register and Information on Business Activity of the Republic of Poland, maintained by the minister responsible for economy, at 43-300, Bielsko-Biała, ul. Gen. Maczka 9, NIP 547-106-61-94, REGON 070511186, hereinafter referred to as the "Controller", who places cookies on the user's end device and has access to them.
The personal data of the Service User and the Customer are processed in accordance with the Personal Data Protection Act of August 29, 1997 (Journal of Laws of 1997, No. 133, item 883, as amended) (hereinafter referred to as the Personal Data Protection Act) and the Act on the Provision of Electronic Services of July 18, 2002 (Journal of Laws of 2002, No. 144, item 1204, as amended).
The data in the form is not made available to third parties except with the user's consent.
The data provided in the form may constitute a set of potential customers, registered by the Website Administrator in the register maintained by the President of the Office for Personal Data Protection with its registered office in Warsaw (00-193), Stawki 2.
The data provided in the form is processed for the purpose resulting from the function of a specific form, e.g., to process a service request or contact sales.
Providing personal data by the User is voluntary.
Users' personal data may also be transferred – to the extent necessary and required – to third parties, including entities performing activities on behalf of the Seller related to the Agreement concluded with the Customer, including entities delivering the ordered goods.
The Seller ensures that Users whose personal data it processes have the right to exercise their rights under the Personal Data Protection Act, including the right to access and correct their own personal data and the right to control the processing of their own personal data under the terms described in the said Act.
As part of the exercise of the right to control the processing of one's own personal data, the User has, in particular, the right to submit a written, reasoned request to cease the processing of his or her data due to his or her specific situation, as well as to object to the processing of his or her data.
Confidential information relating to Users, including Users' personal data, is protected by the Seller against disclosure to unauthorized persons, as well as against other cases of disclosure or loss, and against destruction or unauthorized modification of the indicated data and information by applying appropriate technical and organizational security measures.
Cookie Policy
In accordance with the provisions of the Telecommunications Law of 16 July 2004 (Journal of Laws of 2004, No. 171, item 1800), the Store uses cookies.
Cookies are computer data, specifically text files, sent by a web server. They are stored on the User's end device and are intended for use with the Store's websites. Cookies contain the name of the website they originate from, their storage time on the end device, and a unique number. The default cookie parameters allow only the server that created them to read the information they contain.
Cookies are used for the following purposes:
a) adapting the content of the Store's websites to the User's preferences and optimizing the use of websites; in particular, these files enable the User's device to be recognized and the website to be properly displayed, tailored to his individual needs;
b) analytical and statistical (analysis of User behavior on the Store website, marketing and in order to tailor the content to individual customer needs);
c) correct configuration of selected Store functions, enabling in particular verification of the authenticity of the browser session;
d) maintaining the User's session, thanks to which the User does not have to re-enter his/her login and password on each subpage of the Store.

The user may delete cookies at any time using the functions available in the web browser he or she uses.
Restricting the use of cookies may affect some of the functionalities available on the Store's website. However, not accepting cookies may cause difficulties in using the Store. By using a browser whose settings allow cookies to be saved on your computer or other device, you consent to the storage of these files on that computer or other device.
Technical breaks
The Seller is not liable for lack of access to the Store caused by force majeure factors.
The Seller reserves the right to interrupt access to the Store due to technical service, maintenance, or work to improve the Store's functionality. The Seller also undertakes to make every effort to ensure that such interruptions occur at night and are as short as possible.
Final provisions
These regulations come into force on May 24, 2018.
